Key Issues of Discussion

       

This is a summary list of the items that you will discuss during the mediation.  This list will help you not only be prepared with financial concerns and information, but it will help you mentally prepare for issues associated with children (if you have any) and how they will be parented.

Are You Ready to Mediate?

This short questionnaire will help you decide if the timing is right for you.  The more positively you can answer the questions, the more likely you will achieve an agreement that works for you, your spouse, and your children (if any).

 

 

Can You Discuss the Kids? 

This self-reflecting questionnaire will help stimulate the thought process on how you might want to parent your child(ren).  It offers realistic questions that should be considered and addressed to insure minimal conflict after an agreement is made.

Parenting Models  

       

This document offers a host of different, proven parenting/custody models that might help you decide one of the most important parts of your parenting agreement.  You are certainly not obligated to use one of the models shown; feel free to be creative and consider what is important in the lives of your children and go from there.

Financial Information You Might Need

       

This will help you gather the necessary financial information so as to be prepared when the equitable distribution of assets is considered.  It will take a little time to put together, however, complete and accurate information is essential to insure that you make informed decisions about what you might receive.

Financial Affidavit 

       

This is a form on which you may enter all of your assets, liabilities, income and expenses.  It is used to help you decide which assets you will retain, which liabilities you will assume and helps determine the level of spousal support, if any.

Lifestyle Analysis

       

This is a form that should be used to determine what your monthly cash flow needs are.  It is primarily used to assist in determining support issues.

Personal Belongings Worksheet

       

This worksheet is designed to permit the parties to list each room in their residence and all of the property contained in that room.  It is a fast and easy way to identify all of the items in the home and helps prevent one spouse from "forgetting" about a particular item.  List each item and place a check-mark in the appropriate column as to who will retain possession.  If it is a higher value item, assign a dollar value to it and balance the worksheet between the two of you.

Client Information

       

This is a very basic document that your mediator will use to gather general information about you and your spouse.  Items such as Name, address, employer, income, education, attorney's name (if you have one) are requested.  Also child and marriage information.
